How much gratuity does a company in (mixed) smaller states and union territories have to provide for?

The liability counts 15 days of wages against each year of service a person completes, for everyone on the roll who will reach five years with you. It builds out of sight in a company that keeps hiring, because what drives it is the basic pay of people with long tenure rather than the size of the roll.

A second test on the wage base took effect on 21 November 2025. Where the allowances left out of wages exceed half the total remuneration, the part above that halfway mark is counted back in. Building a salary structure on a thin basic pay no longer keeps the liability small.

What kind of employers is Offrd built for in these smaller states and union territories?

This group runs from one of India's most industrialised small states to two territories whose own government profiles literally describe them as having no industry at all, so a single average figure would mislead more than it would inform.

Himachal Pradesh's pharma beltBaddi, Barotiwala, Nalagarh650 plus units, 35 percent of India's medicines

The best documented industrial cluster in this entire group, with genuine export and investment figures behind it, detailed on its own state page.

Sikkim's named pharma majorsEast District, GangtokCipla, Sun Pharma, Glenmark, Torrent, Intas, Zydus

A real cluster of large Indian pharmaceutical companies, though the district's own profile admits it has no turnover or export figure to attach to any of them.

Lakshadweep, a self described zero industry areaUT wide0 large or medium units

The territory's own government profile uses that exact phrase, with a small tuna fishing cluster on Minicoy island the one real, documented activity.

Andaman and Nicobar's timber baseSouth Andaman, Middle Andaman5 named medium units, all sawmills

The territory's own profile states plainly there is no large scale industry here either, a pattern that recurs across several of the smaller Northeast states and Himalayan union territories in this group.

Each state or union territory runs its own District Industries Centre for registration.

Confirm this before you rely on it. Every figure on this hub page is drawn from the individual state or union territory page it summarises, linked from here, rather than estimated fresh. Several of these places genuinely have little or no published industrial data, and we have said so directly rather than paper over the gap. Office addresses and contact details can change on a notification you will not see. Verify the office and its current jurisdiction before you act on it, and take advice from your chartered accountant or labour law adviser. None of this is legal or tax advice. Offrd has no connection to the offices named and does not represent them. Checked 12 September 2026. Spot something out of date? Tell us at service@offrd.co.

Does a labour welfare fund contribution apply here?

Only some states run a labour welfare fund, and where one exists both the employee and the employer contribute small fixed amounts set by the state. Collection is monthly in some states, half yearly or annual in others, and the coverage threshold is set by the state Act.

For a single state employer it is a minor task once or twice a year. For a company with offices in several states it gets fiddly, because the amount, the frequency and whether the fund exists at all change at the border.

How do minimum wages change during the year?

Minimum wages are notified by the state for each scheduled employment and skill level, and most states revise the dearness allowance component twice a year. A rate that was correct in March can be out of date in April without anyone in the company noticing, because nothing in payroll flags it.

The exposure is not just the shortfall. Provident fund, employee state insurance and bonus calculations all sit on top of wages, so an under revised rate makes several numbers wrong at once.

What should a confirmation letter say?

The date the probation started, the date confirmation takes effect, the designation on confirmation, any change in salary, and the notice period that now applies. That last line is the one most often left out, and it is the one that gets quoted at exit.

Issuing it on time is a calendar problem more than a writing problem. A company in (mixed) smaller states and union territories with twenty people has a confirmation due most months, and they are easy to miss.

Frequently asked questions

Who collects professional tax from a None employer?

Professional tax is not a single national rule across this group. It is levied in Tripura, Mizoram, Nagaland, Manipur, Sikkim and Meghalaya. It is not levied in Himachal Pradesh, where the Act was repealed with effect from 1 November 2005.

Is the labour welfare fund the same as provident fund?

No. It is a state run welfare fund with small fixed contributions, separate from provident fund and from employee state insurance, and it is deposited with the state welfare board rather than with a central body.

Do small employers in (mixed) smaller states and union territories have to run provident fund?

Only once twenty employees are on the rolls, unless the establishment opts in voluntarily. Plenty of companies register earlier because candidates ask for it and because it is easier to start clean than to backfill contributions later.

The part that catches people out is the universal account number. An employee who has worked before already has one, and it has to be linked rather than a second one created. Two active numbers for the same person is one of the more tedious things to unwind with the fund office.

How does overtime work for (mixed) smaller states and union territories employers?

Where it applies, overtime is paid at twice the ordinary rate of wages, and the daily and weekly hour caps come from the state Shops and Establishments Act or the Factories Act depending on the establishment. Managerial and supervisory roles are usually outside the overtime provisions, and where the line falls is set by the applicable Act rather than by the job title.

The record matters as much as the rate. Overtime claimed without an hours record is hard to defend either way.

How much gratuity does a company in (mixed) smaller states and union territories have to provide for?

Enough to pay 15 days of wages for every completed year of service for every employee who will cross five years. For a growing company that number gets large quietly, because it is driven by the basic pay of long serving people rather than by headcount.

Since 21 November 2025 there is a second check on the wage base. Where allowances excluded from wages exceed half of total remuneration, the excess is added back. A salary structure that kept basic pay thin to hold the liability down no longer does so.

Does employee state insurance apply to a small office in (mixed) smaller states and union territories?

It depends on two things: how many people are employed, and what the state notification says for establishments that are not factories. The Act covers factories with ten or more people in the first instance, and state governments extended it to shops, hotels and similar establishments by notification. Because that extension is a state decision, the headcount trigger varies.

Where it does apply, the employee half is a payslip deduction and the employer half is a cost above salary. Both are calculated on gross wages, not on basic pay, which is where the arithmetic differs from provident fund.

What should an offer letter in (mixed) smaller states and union territories actually contain?

There is no statutory format for an offer letter in India, which is exactly why so many of them are thin. A usable one names the legal entity making the offer, the job title, the reporting line, the work location, the date of joining, the gross annual salary with its components set out separately, the probation length, the notice period on both sides, and a date by which the candidate has to respond. Leave any of those out and the argument happens later, usually at exit.

The component split matters more than the headline number. Basic pay drives provident fund, gratuity and leave encashment, so a letter that shows only a single annual figure tells the candidate nothing about take home pay. Offrd builds the letter from the salary structure you set up once, so the breakup in the offer, the appointment letter and the first payslip are the same numbers.
