Does employee state insurance apply to a small office in Kohima?

It depends on two things: how many people are employed, and what the state notification says for establishments that are not factories. The Act covers factories with ten or more people in the first instance, and state governments extended it to shops, hotels and similar establishments by notification. Because that extension is a state decision, the headcount trigger varies.

Where it does apply, the employee half is a payslip deduction and the employer half is a cost above salary. Both are calculated on gross wages, not on basic pay, which is where the arithmetic differs from provident fund.

How much gratuity does a company in (mixed) smaller states and union territories have to provide for?

Enough to pay 15 days of wages for every completed year of service for every employee who will cross five years. For a growing company that number gets large quietly, because it is driven by the basic pay of long serving people rather than by headcount.

Since 21 November 2025 there is a second check on the wage base. Where allowances excluded from wages exceed half of total remuneration, the excess is added back. A salary structure that kept basic pay thin to hold the liability down no longer does so.
