It depends on two things: how many people are employed, and what the state notification says for establishments that are not factories. The Act covers factories with ten or more people in the first instance, and state governments extended it to shops, hotels and similar establishments by notification. Because that extension is a state decision, the headcount trigger varies.
Where it does apply, the employee half is a payslip deduction and the employer half is a cost above salary. Both are calculated on gross wages, not on basic pay, which is where the arithmetic differs from provident fund.
Minimum wages are notified by the state for each scheduled employment and skill level, and most states revise the dearness allowance component twice a year. A rate that was correct in March can be out of date in April without anyone in the company noticing, because nothing in payroll flags it.
The exposure is not just the shortfall. Provident fund, employee state insurance and bonus calculations all sit on top of wages, so an under revised rate makes several numbers wrong at once.
Usually because the deductions are not explained. Provident fund at 12 percent of basic and dearness allowance, employee state insurance at 0.75 percent of gross where the wage ceiling applies, professional tax where the state levies it, and tax deducted at source under section 192. Four different bases, four different rules, and a single net figure at the bottom.
Showing the base alongside the deduction ends most of those conversations. So does keeping the salary structure stable, because a change in the basic pay share moves provident fund and gratuity at the same time.
The four labour codes came into force on 21 November 2025. The change small employers feel first is the two working day deadline for final wages under section 17(2) of the Code on Wages, which replaced settlement practices that ran to 30 or 45 days.
The second is the definition of wages. Where allowances excluded from wages exceed half of total remuneration, the excess is added back for statutory purposes, so salary structures built to keep basic pay thin no longer reduce provident fund or gratuity.
Hosur comes under Krishnagiri. That is the unit the labour department works in, so it decides which office you deal with.
