Leave without pay in India: rules and payroll treatment

Leave without pay, or LWP, is unpaid authorised absence taken after paid leave runs out. No Indian law defines it for private employees, so the terms come entirely from company policy. What is the difference between LWP, LOP and unpaid leave?

They are the same thing seen from two ends. HR says leave without pay for the leave decision, payroll says loss of pay for the deduction. The leave decision is discretionary: the employer chose to authorise absence without salary instead of refusing it. The payroll consequence is mechanical: days not paid are deducted from the month at the daily rate.

The word authorised is what separates LWP from absconding. Unauthorised absence is a conduct issue, handled with warnings and, if it continues, a termination process. Authorised unpaid absence is a grant. If the policy never says who can authorise it, for how long and on what grounds, each manager decides case by case, and two employees with the same situation get different answers.

How is loss of pay calculated?

One LOP day removes one day of salary, computed as the month's gross divided by the days convention your payroll uses, calendar days or a fixed 30. Pick one convention and keep it, because switching mid year creates arrears disputes. Show the LOP days and the deduction as their own line on the payslip, so the employee can check the number themselves. A generated payslip carries that line for you.

The second order effects are the ones employers miss. A lower gross that month changes the base for percentage linked statutory deductions. What should an LWP policy say?

Five clauses cover it. Sequence: paid leave first. LWP starts only after casual, sick and earned balances are used, in a stated order. This stops employees from saving earned leave for encashment while taking unpaid days.

Authority and duration: who approves, and in what blocks. A common design lets managers grant up to a week and sends anything longer to HR, with an outer limit per year. Grounds: medical situations that outrun sick leave, family care, study, and whatever else you intend to allow. Continuity: say whether LWP days count as service for accruals and increments; most policies pause accruals during unpaid stretches. Return: a date, and what happens if it passes without contact.

How should long LWP be handled?

Short LWP resolves itself. The hard cases are long ones: a parent's illness with no end date, a visa problem, a recovery that keeps slipping. The usual failure is drift. Both sides extend month by month, nobody says what they expect, the role gets covered by someone else, and the return turns into a fresh negotiation.

The fix is a schedule, agreed at the start of any LWP longer than a month: a check in every few weeks, a named contact, and a review date on which the arrangement is renewed in writing or converted into something clearer, a sabbatical with proper terms, a part time arrangement, or an exit with a clean full and final settlement. An employee in month four of unpaid leave should not have to guess whether their job still exists, and neither should you.

If the person stops responding past the agreed return date, follow the abandonment process in your policy: written notice to the address on record, a stated reply window, and only then the exit paperwork. Skipping the notice step is how a clean case becomes a disputed one.
