A record of days worked, leave taken and days lost for each employee, kept as the month goes on. Under the state Shops and Establishments Act this sits alongside the wage register, and most states now accept it in digital form.
The record serves three purposes at once: the payslip, the contribution returns, and the leave balance that will be encashed when someone leaves. A single source for all three is the point.
The clause itself is binding, because a signed appointment letter is a contract under the Indian Contract Act, 1872. What no Indian court will do is order a person back to work. Enforcement runs through money, usually recovery of pay for the unserved days through the full and final settlement.
That is why the deduction authority in the appointment letter matters. Without it, recovering notice pay from the settlement is harder than it needs to be.
The appointment letter and any revisions, the attendance and wage record, the leave record, contribution proofs, and the exit documents. Retention periods come from the Act that applies, commonly three years for wage and attendance registers and longer in several states.
For a small employer in India, the practical rule is to keep the employment file intact for as long as the person could raise a claim, which is longer than the register retention period.
On the earned leave balance, using the last drawn wage. Casual and sick leave normally lapse and are not encashed, which is why the three leave types have to be tracked separately rather than as one pool. Earned leave accrues against days worked and carries forward to a state specific cap, so the balance is a real liability on the books.
Getting the accrual rate wrong makes the settlement wrong. The rate comes from the state Shops and Establishments Act, not from a national rule.
Yes. The obligation attaches to the employment, not to the office. A remote team still needs days worked, leave taken and loss of pay recorded, because the payslip and the contribution returns are built from those figures.
